A new set of CFO forms is now available.

The Court Funds Rules 2011 came into force on 3rd October 2011. These new Rules replace the existing Court Funds Rules 1987.

About

The Court Funds Office (CFO) provides a banking and administration service for the civil courts throughout England and Wales, including the High Court. We account for money being paid into and out of court and, as directed by the court, look after any investments made with that money. The Accountant General of the Senior Courts is responsible for the proper control of all money paid into court.  Our clients are people who have money ‘held in court’. These can be:

  • Children awarded damages as a result of civil legal action in a county court in England or Wales or the High Court of Justice
  • Cases where money is held  in court pending settlement of civil court action, dissenting shareholders, widows, and other clients whose funds are held under a variety of different statutes

Our work is governed by the Administration of Justice Act (AJA) and Court Funds Rules, which gives us the authority to accept and hold payments into court until we are instructed to pay them out.

The Court Funds Office (CFO) was established in 1726 by an Act of Parliament and the creation of the post of Accountant General of the Court of Chancery (later to become CFO).

The Head of the Court Funds Office is Eddie Bloomfield.

Please note:

Any requests for payment of monies for the benefit of the child before their 18th birthday, or for the person who lacks capacity at any stage, must be made directly to the local Court responsible for administering the fund, CFO's role is to administer funds paid into court, we can only act upon courts instructions, and in line with our agreed and set investment framework.

The consultation sought views from regular users of the Court Funds Office (CFO) on a draft version of the new Court Funds Rules which govern the administration and management of funds held in court.

Response to informal consultation

Fourteen responses were received to the consultation from a wide variety of stakeholders including the judiciary, members of the legal profession, investment advisers, Office of the Public Guardian, Court of Protection, Her Majesty’s Courts and Tribunals Service, CFO staff and a member of the public.

This report summarises the responses and, where appropriate, explains how certain issues raised have influenced the final shape of the Rules.
