This consultation sought views on a package of measures designed to better control costs in defamation and possibly some other publication-related proceedings where the level of costs might be considered too high.

Response
We received 65 responses to the consultation paper: 33 from media companies and their representative organisations, 17 from legal professionals, three from legal representative organisations, three from insurers, three from members of the judiciary and six from other respondents.
In the light of the responses, the Ministry of Justice asked the Civil Procedure Rule Committee to consider draft rules to implement a number of measures to control costs in publication proceedings. The committee approved amendments to the rules, practice directions and pre-action protocol that are outlined in the response paper.
