A consultation on the next step in the review of the Mental Capacity Act 2005, addressing areas of legislation and policy that in practice have not worked as well as intended.
The proposed changes will help the Act meet its aims and objectives. The Office of the Public Guardian intends to implement them on the 1 April 2010 and is now seeking views.

Response
There were 31 responses to the consultation from a wide range of respondents including legal professionals and local authorities.
There was generally broad support for the proposed amendments to secondary legislation and as such the government has decided to implement the proposed changes from the 1 May 2010.
