Introduction
The first Update to the Family Procedure (Adoption) Rules contains amendments to the Rules, Practice Directions and Forms and they come into force on 1st October 2007.
Amendments have been made to Parts 2, 5, 6 and 7 of the Rules, the Practice Directions supplementing Parts 2, 4, 7 and 19 and Forms A50, FP1A, FP6 and FP9.
Parts 2, 5, 6 and 7 of the Rules contain amendments to terminology arising out of the Mental Capacity Act 2005.
Practice Directions supplementing Part 2, rule 7(1)(c)(ii)(bb), Part 4, rule 17, Part 7 and Part 19 contain amendments to terminology arising out of the Mental Capacity Act 2005.
Practice Direction supplementing Part 8, rule 78(1)(b) contains amendments to the provisions permitting the communication of information relating to proceedings.
Form A50 contains an amendment to the wording of the form of application for a placement order so as to reduce the risk of details of adoption proceedings relating to a sibling of a child who is the subject of a placement application from being disclosed inadvertently.
Forms FP1A, FP6 and FP9 contain amendments to terminology arising out of the Mental Capacity Act 2005.
The Family Procedure (Adoption) Rules 2005 were made by the Family Procedure Rule Committee in October 2005 and came into force on 30 December 2005. In due course, the Committee will be making full Family Procedure Rules governing the practice and procedure for all family proceedings in the High Court, county courts and magistrates’ courts.
