LAC1 Legal Aid Committal form

LAC1 Legal Aid Committal (PDF)

This form should be completed and signed for all Either Way cases that are directed to the Crown Court by the magistrates.

The form must be submitted to the LAA along with the claim for payment and a copy of the form must be provided to the instructed Advocate.

  • The LAC1 form can be signed not only at at the Committal hearing (as indicated on the form), but also at the mode of trial hearing and any other hearing where the venue is known.
  • Where the defendant is unrepresented, the provider is able to obtain a memorandum of conviction from the court. This costs £5, and we will pay this as a disbursement.

Judicial apportionment

Judicial Apportionment (PDF)

Judicial Apportionment Orders must be submitted with Litigator and Advocate graduated fee claims in order that the final defence costs can be properly calculated.

Where a client is convicted in the Crown Court of one or more but not all offences, there is provision under Regulation 21 of the Criminal Defence Service (Contribution Orders) Regulations to apply to the Judge for an order to pay a proportion of final defence costs. 

Where an order is made, it is vital that a copy of the Judicial Apportionment Order is submitted with the claim for payment, otherwise it will not be possible to apply the apportionment and the client could be asked to pay more of their costs. 

Whilst this is made clear on Forms LF1/AF1, an increasing number of queries have been received on this point.
