Secondary Legislation for Electoral Administration Act 2006

The following statutory instruments for the Electoral Administration Act 2006 have been laid in Parliament and implemented. Their provisions include: governing the process concerning anonymous registration; improving the security of the postal voting system; and extending access to the electoral process.

  • This Order bring into force some provisions of The Political Parties, Elections and Referendums Act 2006 which are tied into the commencement of Electoral Administration Act provisions
The Registration of Political Parties (Prohibited Words and Expressions) (Amendment) Order 2006 (SI 2006/3252)
  • Prohibits political parties from including in descriptions registered with the Electoral Commission certain words and expressions; being the same as those prohibited from use in the parties' names

  • Changes provisions concerning postal and proxy voting;
  • Supply of, and access to, the electoral register; and
  • Polling hours at elections

  • Changes the hours of polling at relevant elections from 8am – 9pm to 7am to 10pm

  • Anonymous registration
  • Amendments to the electoral register in respect of clerical errors
  • Provision of personal identifiers
The Service Voters' Registration Period Order 2006 (SI 2006/3406)
  • Extends duration of service voters' registration as an elector from 12 months to 3 years
The Review of Polling Districts and Polling Places (Parliamentary Elections) Regulations 2006 (SI 2006/2965)
  • Require an authority to keep the designation of polling places and districts within its area under review
The Absent Voting (Transitional Provisions)(England and Wales) Regulations 2006 (SI 2006/2973)
  • Provides for the capture of the personal identifiers of existing absent voters
The Encouraging Electoral Participation (Reimbursement of Expenses)(England and Wales) Regulations 2006 (SI 2006/2972)
  • Provides for the reimbursement of expenditure incurred in the promotion of electoral participation
The Political Donations and Regulated Transactions (Anonymous Electors)(England and Wales) Regulations 2006 (SI 2006/2974)
  • Prescribe the form of evidence required to establish that a donor with an anonymous entry is a registered elector
The Representation of the People (Combination of Polls) (England and Wales) (Amendment) Regulations 2006 (SI 2006/3278)
  • Makes a number of technical and necessary changes to provide for the combination of a Parliamentary election with another election

  • Govern the conduct of local elections and reflect changes implemented from the Electoral Administration Act
The Local Elections (Parishes and Communities)(England and Wales) Rules 2006 (SI 2006/3305)
  • Govern the conduct of local elections and reflect changes implemented from the Electoral Administration Act
Local Authorities (Mayoral Elections)(England and Wales) Regulations 2007 (SI 1024/2007)
  • Implement the changes made by the Electoral Administration Act 2006 into the conduct of elections for Mayors under the Local Government Act 2000;
  • Re-enact certain provisions of the 2002 regulations which it replaces; and
  • Increase the limits of election expenses for such contests
Representation of the People (England and Wales) and Representation of the People (Combination of Polls)(England and Wales)(Amendment) (SI 1025/2007)
  • Removes references that provide for electors to sign for their ballot paper; and
  • Provide for new forms for Corresponding Number Lists (CNL)

The Local Elections (Principal Areas) (Welsh Forms) Order 2007 (SI 2007/1015)
  • Changes have been made to a number of existing electoral forms, and some new ones have been created. The Welsh Forms Orders provide translations of these forms in Welsh and partly in English, of these forms and form of words, for use at elections in Wales. The Orders revoke all previous Welsh forms orders relating to parliamentary, principal area and community council elections
The Local Authorities Conduct of Referendums Regulations (England)(Regulations) 2007 (SI 2007/2089)
  • This makes changes necessary to implement changes made by the Electoral Administration Act 2006
  • Sets out the Rules for the conduct of referendums in full
  • Removes the option of a referendum being conducted by means of an all-postal ballot
