This consultation builds on recommendations stemming from the Data Sharing Review recently conducted by Richard Thomas, the Information Commissioner, and Dr Mark Walport, Director of the Wellcome Trust.

The government sought views on proposed changes to the inspection powers and funding arrangements of the Information Commissioner's Office. Specifically we sought views on proposals to:

  • promote good practice
  • enforce compliance by enhancing the Commissioner's inspection powers under the Data Protection Act 1998
  • amend the structure for funding the Information Commissioner's data protection duties.

Responses

We received 72 responses to the consultation which informed our proposals.

The amendments we have outlined, used rigorously and effectively in conjunction with the current powers of the Information Commissioner's Office, should enable it to regulate our data protection laws effectively at the same time as increasing public trust in how data is handled by organisations in the private and public sectors.
