Acting for children

The Official Solicitor also acts as next friend or guardian ad litem of a child party whose own welfare is not the subject of family proceedings. The most common examples are listed in the Practice Note of 2 April 2001 entitled Official Solicitor: Appointment in Family Proceedings [2001].

The Official Solicitor will seek to determine the child's best interests within the litigation and take all measures necessary within the proceedings for the child's benefit.
