Monetary claims in county courts
Date: 22 January 2010
Case management for defended cases was a key part of the Civil Procedure Rules.
The research is based on data from county court files between September 2002 and December 2003, and an analysis of 2,120 monetary claims allocated to the two case management tracks, from seven county courts.
The findings show that, in most cases, guidelines were followed, listing and allocation questionnaires completed on time and trial windows given in line with the rules.
This adds to evidence that the Civil Procedure Rules, and in particular the case management process, was able to increase certainty on how quickly a case would progress through the court.
