Decisions - Administrative appeals Tribunal guidance

Most appeals are usually decided without an oral hearing. The judge will consider:

  • the documents from the First-Tier or other Tribunal or the body which made the decision under appeal (e.g. ISA)

  • the grounds of the appeal

  • the written comments by all parties to the appeal
You can make a request to have a hearing which a judge will consider. Sometimes the judge will decide that there should be a hearing in any event.  If there is a hearing you will be sent details of where and when it will be held.

The decision on your appeal will be in writing and you and all other parties will be sent a copy.

The judge may decide to:

  • allow your appeal and either:
    • tell the original Tribunal to hear your appeal again, or
    • re-make the Tribunal’s decision
  • dismiss your appeal
