What's New?
39th Update - This update of the Civil Procedure Rules, published on 24th March, includes new provisions to amend the Rules in line with section 26 of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004, specifically so that parties to an appeal to the newly created Asylum and Immigration Tribunal (AIT) may apply to the High Court for an order that the AIT reconsider its decision on an appeal, on the ground that it made an error of law. The update also makes a small alteration to CCR O.49.
In addition, it has now been confirmed that the elements of Update 37 due to come into force on the date of entry into force of sections 100 and 101 of the Courts Act 2003 will be coming into force on 1st April 2005.

38th Update - This update of the Civil Procedure Rules, published on 24th March, includes a number of notable amendments, including clarification of the fixed costs provisions, a new part (67) relating to proceedings against solicitors and a completely revised Personal Injury Protocol. Also included are clarifications of the process for appealing against a decision of a Social Security or Child Support Commissioner, and changes to wording of statements of truth and service of orders on experts.

Part 76 is a new part introduced to cover Proceedings under the Prevention of Terrorism Act 2005. This came into force on 11 March 2005 and will be incorporated into the 40th update, due for publication in August. Link to the SI.
