This update includes amendments to the Family Procedure Rules contained in the Family Procedure (Amendment) (No.3) Rules 2012.
Amendments to the Rules are found in:
Part 2 Application and Interpretation of the Rules
Part 12 Proceedings Relating to Children except Parental Order Proceedings and Proceedings for Applications in Adoption, Placement and Related Proceedings
The amendments to Part 2 are to make it clear that when the Family Procedure Rules apply Order 52 of the Rules of the Senior Courts and Order 29 of the County Court Rules, they are applying those rules as they appeared in Schedule 1 and Schedule 2 to the Civil Procedure Rules on 30 September 2012 and not subject to any amendment or revocation effected after that time. The text of Order 52 of the Rules of the Senior Courts and Order 29 of the County Court Rules as they appeared in Schedule 1 and Schedule 2 to the Civil Procedure Rules on 30 September 2012 may be found within Update 58 PDF at http://www.justice.gov.uk/courts/procedure-rules/civil/update.
The amendments to Part 12 reflect the fact that in relation to the Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-Operation in Respect of Parental Responsibility and Measures for the Protection of Children, “the 1996 Hague Convention”, there are separate Central Authorities for England and for Wales.
The Rule amendments come into force on 30 September 2012.
An html FPR index is available. Should you have any comments about the web index we'd appreciate your feedback.
Her Majesty's Courts and Tribunals Service (HMCTS) is responsible for the provision of the FPR forms - if you have any comments or observations about the availability of court forms, please e-mail HMCTS.
HMCTS launched a new-look website which has resulted in changes to many of its links. If you bookmarked any forms prior to 30 January you will need to re-mark them.
