PRACTICE DIRECTION 12H – CONTRIBUTION ORDERSThis Practice Direction supplements FPR Part 12

1.1

Paragraph 23(6) of Schedule 2 to the 1989 Act provides that where –

(a) a contribution order is in force;

(b) the local authority serve another contribution notice; and

(c) the contributor and the local authority reach an agreement under paragraph 22(7) in respect of that other contribution notice,

the effect of the agreement shall be to discharge the order from the date on which it is agreed that the agreement shall take effect.

1.2

Where a local authority notifies the court of an agreement reached under paragraph 23(6) of Schedule 2 to the 1989 Act, the notification must be sent in writing to the designated officer of the court.
