NOTES TO ACCOMPANY MARCH 2003 31st SUPPLEMENT

Introduction

The 31^st update of the Civil Procedure
Rules amends Part 54 by inserting a new section II of Part 54 containing rules
about applications to the High Court under section 101(2) of the Nationality,
Immigration and Asylum Act 2002. This section provides that a party to an
application to the Immigration Appeal Tribunal for permission to appeal against
an adjudicator’s determination may apply to the High Court for a review of the
Tribunal’s decision on the grounds that the Tribunal made an error of
law.

A number of minor PD amendments are also made. A full list of
the changes is set out below:

Part 54

Title amended to ‘Judicial Review And Statutory Review’.

List of Contents replaced. Judicial Review and Statutory Review heading inserted under Part 54.

In Rule 54.1, Paragraph (1), ‘This Part’ replaced by ‘This Section of this Part’.

In Rule 54.1, Paragraph (2), ‘In this Part’ replaced by ‘In this Section’.

In Rule 54.1, Sub-Paragraph (e), ‘this Part’ replaced by ‘this Section’.

In headings of rules 54.2 and 54.3, ‘Part’ replaced by ‘Section’.

In rule 54.4, ‘Part’ replaced by ‘Section’.

In rule 54.16, ‘Part’ replaced by ‘Section’.

In rule 54.20, sub-paragraph (a), ‘Part’ replaced by ‘Section’.

After rule 54.20, new Section II inserted on Statutory Review under the Nationality, Immigration and Asylum Act 2002.

Practice Directions

Practice Direction 52

Paragraph 20.3, in table, Competition Commission Appeals Tribunal changed to Competition Appeal Tribunal. Heading before paragraph 21.10 changed to Competition Appeal Tribunal. Existing paragraph 21.7 replaced by new text.

Practice Direction 54

In paragraph 2.3, existing address replaced with new address. In paragraph 5.3, ‘paragraph 16’ replaced by ‘paragraph 15’ (this rectifies an existing cross-referencing error). In paragraph 5.9, ‘paragraphs 4.6 and 4.7’ changed to ‘paragraphs 5.6 and 5.7’ (this rectifies an existing cross-referencing error).

Coming into force

All changes come into force on 1 April 2003, except the
amendments to cross-references, which take immediate effect.
