Transitional provisions

36.1

Practice Direction 36A shall make provision for the extent to which these rules shall apply to proceedings started before the day on which they come into force.

Pilot schemes

36.2

Practice directions may modify or disapply any provision of these rules-

(a) for specified periods; and

(b) in relation to proceedings in specified courts,

during the operation of pilot schemes for assessing the use of new practices and procedures in connection with proceedings.

Domestic Abuse Act 2021: provision during pilot commencement of Part 3

36.2A

(1) Practice directions may make provision for proceedings in relation to Part 3 of the Domestic Abuse Act 2021(1) during any period when, pursuant to regulations made under section 90(7) to (9) of that Act, any provisions of that Part are in force only for a specified purpose, in relation to a specified area or for a specified period.

(2) The provision made by a practice direction under paragraph (1) may include provision modifying or disapplying any provision of these Rules.”
