Coming into force

The Family Procedure (Amendment) Rules 2012 and the Amending Practice Direction come into force on 6 April 2012

Introduction

Part 7 Procedure for Applications in Matrimonial and Civil Partnership Proceedings

Amendments are made to provide that applications in support of a matrimonial or civil partnership order in undefended proceedings shall be verified by a statement of truth, rather than being supported by an affidavit.

Consequential amendments are made in Part 6 and in Practice Directions PD5A and PD6A.

Part 9 Applications for a Financial Remedy

Amendments are made to provide that financial statements filed in support of applications for a financial remedy shall be verified by a statement of truth, rather sworn or affirmed.

A new rule is inserted specifically providing that the court may direct that a person or body be added (or removed) as a party to financial remedy proceedings.

Part 29 Miscellaneous

A new rule is inserted regarding access and inspection of court documents.
